Terms of Service

These Terms of Service ("Terms") govern your use of the website, apps, and related services offered by Cognitive Brain Apps, LLC ("Cognitive Brain Apps," "we," "us," or "our"), including Memory Enhancer and Memory Caregiver (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Not medical advice. The Services are general wellness tools. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or condition, and they do not provide medical advice. Using the Services does not create a doctor–patient or other professional relationship. Always seek the advice of a qualified healthcare professional with any questions about a medical condition, and never disregard professional advice because of something in the Services.

1. Eligibility

You must be at least 18 years old, or use the Services under the supervision of a parent or guardian who agrees to these Terms. By using the Services, you represent that you meet this requirement.

2. Your use of the Services

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial wellness purposes, subject to these Terms. You agree not to:

Use the Services for any unlawful, harmful, or fraudulent purpose;
Copy, modify, reverse-engineer, or create derivative works of the Services except as permitted by law;
Interfere with or disrupt the Services or attempt to gain unauthorized access to them; or
Use the Services to violate the rights of others.

3. Accounts, data, and Apple services

The apps rely on Apple services, including iCloud and CloudKit, to store your practice data in your own Apple account and to enable optional sharing with a care partner. Your use of Apple's services is subject to Apple's terms. You are responsible for maintaining the security of your device and Apple account. Our handling of information is described in our Privacy Policy.

4. Care-partner sharing

If you choose to share your progress with a care partner, you are responsible for deciding whom to invite and for ending sharing when you wish. Care partners agree to use shared information only to support the person who invited them.

5. Intellectual property

The Services, including their software, design, text, graphics, and logos, are owned by Cognitive Brain Apps or its licensors and are protected by intellectual-property laws. These Terms do not transfer any ownership rights to you.

6. Third-party services

The Services depend on third parties such as Apple and our hosting provider, Cloudflare. We are not responsible for the availability, content, or practices of third-party services, and your use of them may be governed by their own terms.

7. Disclaimers

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that results from memory practice will meet your expectations. Individual results vary.

8. Limitation of liability

To the fullest extent permitted by law, Cognitive Brain Apps and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Services. To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim, or twenty-five U.S. dollars ($25).

9. Indemnification

You agree to indemnify and hold harmless Cognitive Brain Apps from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Services or your violation of these Terms.

10. Changes and termination

We may modify the Services or these Terms at any time. If we make material changes to these Terms, we will update the effective date above and, where appropriate, provide additional notice. We may suspend or end the Services, or your access to them, at our discretion. You may stop using the Services at any time.

11. Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Washington, unless applicable law requires otherwise.
